Hyatt retains control of Coolum resort

Brisbane Supreme Court Justice Roslyn Atkinson last week ordered that Hyatt Hotels Corporation would continue to run the Hyatt Coolum Resort without interference from billionaire Clive Palmer

until the conclusion of any trial into allegations it was unfit to do so.

Mr Palmer announced late last month that he had terminated his agreement with Hyatt to run the resort, citing the company’s poor business performance, alleged syphoning off of profits and its lack of consultation with and commitment to resort staff.

Justice Atkinson has forbidden the three respondents – Mr Palmer, Coolum Resort P/L and Coeur De Lion Investments – from interfering with Hyatt’s access to accounts related to the operations of the resort until the matter goes to trial. The respondents are also banned from giving directions to staff at the resort, and from removing any Hyatt signage.

In her written judgment, Justice Atkinson said Mr Palmer had so far been unable to provide a persuasive case that Hyatt Hotels Corporation had breached its terms of the management agreement.

No date has been set for the case to go to trial.
