Developer appeals state planning minister decision
David Marriner’s Forum Theatre Holdings has appealed the decision not to approve a $70 redevelopment of the Forum Theatre side in the Supreme Court.
Last year, the tribunal found that “as each project was for a development of less than 25,000 square metres, the correct responsible authority in each case was Melbourne city council, not the minister for planning”.
The developer claimed in the appeal that VCAT deputy president Helen Gibson had erred in law, according to the Herald Sun.
The redevelopment, if approved, would include a 32-level hotel and retail area plus a theatre refurbishment.
