Airbnb makes hosts liable

Airbnb has thrown the onus of local by-laws and restrictions onto its hosts. Airbnb e-mailed users about the changes this week and said all hosts must agree to them by April 30.

“In particular, hosts should understand how the laws work in their respective cities. Some cities have laws that restrict their ability to host paying guests for short periods. These laws are often part of a city’s zoning or administrative codes. In many cities, host must register, get a permit or obtain a license before listing a property or accepting guests. Certain types of short-term books may be prohibited altogether.”

Airbnb makes it clear that if something goes wrong, hosts shouldn’t expect help. “You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the site, application and services, and your listing of any accommodations… remains with you,” the company said, When it comes to leases – many of which ban subletting – Airbnb says hosts better know what their landlord or body corporate allows them to do, and comply with all local laws and tax requirements.

After a recent funding round of more than $400 million, the San Francisco company is now valued at more than $10 billion, more than many hotel chains. With the prospect of a big initial public offering some day, the company wants to legitimise itself by cooperating with city regulators.

Another problem facing the Airbnb image is that prostitutes are increasingly using the Airbnb homesharing web site to ply their trade. One escort service is even saving a bundle by renting Airbnb apartments instead of hotel rooms.
Renting out private apartments — often without the owner knowing their home is being used for sex — is cheaper and helps hookers avoid the prying eyes of hotel staff.
